 Dispute resolution, arbitration & class‑action waiver

Informal resolution first. Before filing a claim, email contact@jwlawfirm.com with “Dispute Notice” and allow 30 days to resolve informally.

Binding arbitration. If unresolved, disputes arising out of or relating to these Terms or the Site will be resolved by binding arbitration before the American Arbitration Association (AAA) under its Consumer Arbitration Rules.


Venue/Seat: Bexar County, Texas (or remote by agreement). • Governing law: Texas (no conflicts rules). • Costs:AAA rules apply; we’ll consider reasonable adjustments if fees are cost‑prohibitive.
Small‑claims carve‑out: Either party may bring an individual claim in small‑claims court.
Injunctive/IP relief: Either party may seek temporary or preliminary relief in court to protect IP or data security.

CLASS‑ACTION WAIVER. YOU AND WE AGREE THAT CLAIMS WILL BE BROUGHT ONLY ON AN INDIVIDUAL BASIS, NOT AS A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate claims or preside over representative or class proceedings.

30‑day opt‑out. You can opt out of arbitration/class waiver by emailing contact@jwlawfirm.com within 30 daysafter you first accept these Terms (subject: “Arbitration Opt‑Out”). Opting out keeps §§ 21–22 applicable.

Time limits. Any claim must be filed within one (1) year after it accrues unless a longer period is required by law.

Governing law & venue (if not arbitrated)

Texas law governs these Terms. For claims not subject to arbitration or the small‑claims carve‑out, exclusive venue lies in the state courts of Bexar County, Texas or the U.S. District Court for the Western District of Texas.

Indemnification

You agree to defend, indemnify, and hold harmless JW Zepeda Law Firm, PLLC, and our partners, attorneys, employees, contractors, service providers, affiliates, referral counsel, and successors/assigns from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site; (b) your User Content (including alleged infringement, defamation, or privacy violations); (c) your violation of these Terms or of any law or third‑party right; or (d) any misrepresentation by you.
